Terms of Service

These Terms govern the use of Postgate AI, a product of BUHIT GmbH. Last updated: July 2026. The German version (AGB) is authoritative; this is a convenience translation.

1. Scope

These Terms apply to all contracts between BUHIT GmbH, Silberburgstraße 157, 70178 Stuttgart, Germany („Provider“) and its customers regarding the use of Postgate AI. The service is aimed exclusively at businesses (entrepreneurs within the meaning of § 14 German Civil Code).

2. Service

Postgate AI connects the customer’s Microsoft Exchange mailbox server-side via an MCP endpoint to the customer’s AI assistants (e.g. Claude, ChatGPT). Access runs with each user’s native permissions on their own mailbox. An optional Outlook add-in is available. The Provider does not supply an AI provider; the customer connects the AI service via their own account.

3. Formation, trial

The customer registers in the portal and creates their organisation. Registration starts a free 7-day trial that ends automatically. A paid contract is formed only upon explicit booking of a plan.

4. Prices and payment

The prices stated in the portal apply. All prices are net plus statutory VAT unless reverse charge applies. Billing is per connected mailbox (seat) per chosen term, in advance, via the payment provider Mollie (card, PayPal, SEPA). Invoices are provided electronically in the portal.

5. Term and cancellation

The subscription renews automatically for the chosen term (monthly, 3 months or annual) unless cancelled to the end of the term. Cancellation is possible anytime in the portal; access remains until the end of the already-paid term. The right to extraordinary termination for good cause remains unaffected.

6. Customer obligations

The customer ensures they are entitled to connect their Exchange server and use the required credentials lawfully. Credentials must be kept confidential. The customer uses the service only within applicable law and is responsible for actions initiated by their users.

7. Availability

The Provider strives for high availability but owes no specific availability unless separately agreed. Maintenance windows and disruptions at upstream providers (in particular hosting, the customer’s Exchange, AI providers) may limit availability.

8. Data protection and processing

The Provider processes personal data as the customer’s processor. The Data Processing Agreement (DPA) concluded at registration applies. Subprocessors are listed on the subprocessors page. Further details are in the privacy policy.

9. Liability

The Provider is liable without limitation for intent and gross negligence and for damage to life, body or health. For simple negligence the Provider is liable only for breach of an essential contractual duty and limited to the foreseeable damage typical for the contract. Any further liability is excluded. Liability under the German Product Liability Act remains unaffected.

10. Changes to the Terms

The Provider may amend these Terms with future effect. Changes are communicated in text form at least six weeks before taking effect. If the customer does not object within six weeks, the changes are deemed accepted; the notice will point this out.

11. Final provisions

German law applies, excluding the UN Convention on Contracts for the International Sale of Goods. The exclusive place of jurisdiction for merchants is Stuttgart. Should individual provisions be invalid, the remaining provisions remain unaffected.
